Presidential Decree No.19318
Promulgated and enforced by Feburary 6, 2006
Article 1 (Purpose)
This decree is to stipulate matters commissioned by 「Framework Act on Volunteer Service Activities」 and what is necessary to enforce them.
Article 2 (Composition of Volunteer Service Promotion Committee)
(1) Volunteer Service Promotion Committee( hereinafter referred to as the "committee") prescribed by Article 8(1) of [Basic
     Act on Volunteer Service](hereinafter referred to as the "Act") shall consist of less than 30 committee members including 1
     chairman and 2 vice chairmen. Committee members are those falling under any of the following subparagraph.
     1. Ex Officio Member: The Minister of Finance and National Economy, Minister of Education & Human Resource
        Development, Minister of Justice, Minister of Health and Welfare, Minister of Gender Equality and Family, Minister of
        Planning and Budget, Minister of the Office for Government Policy Coordination, Government Information Agency Head,
        and Chairman of Government Youth Commission
     2. Private Member: Among those who have in-depth knowledge and experience about voluntary service, person who is
        recommended by Korea Council of Volunteering prescribed by the Article 13, the Minister of Education & Human
        Resource Development, Minister of Health and Welfare, Minister of Gender Equality and Family or the Chairman of
        Government Youth Commission and appointed by the Prime Minister
(2) Chairman of the committee is the Prime Minister and vice chairman is elected by mutual vote among private members,
     and the Minister of Government Administration and Home Affairs.
(3) Private members shall be a majority among members prescribed by paragraph 1
(4) Private member shall serve 2 year term.
(5) Chairman shall represent the committee and controls operations
(6) Vice chairman shall assist chairman and in case when chairman can not fulfill his or her role the role of acting chairman
      shall be served by in the order of the Minister of Government Administration and Home Affairs and private vice chairman.
Article 3 (Operation of the Committee)
(1) A meeting of the committee shall be held by chairman if he or she deems it necessary or if one fourths of members
     present request it. If chairman wants to call a meeting a date and place of the meeting and agenda submitted for
     consideration shall be notified to each member in writing 5 days earlier the meeting date. Provided, in the case of
     emergency none of the above provisions shall not be required.
(2) A meeting shall start with the attendance of more than one half of the total members and any matters shall be decided
     by majority of the members present.
(3) A head of central government organization designated by chairman may be present in the committee and speak about
     matters submitted for consideration, if necessary.
(4) 1 manager shall be in the committee to deal with office work and he or she shall be a civil servant in charge of volunteer
     service from the Ministry of Government Administration and Home affairs
(5) The committee may have not more than 5 members within it to conduct professional research and study concerning
     promotion of volunteer service
(6) An expert adviser as prescribed in the Article 5 shall be appointed by the Minister of Government Administration and
     Home Affairs among those with in-depth knowledge and ample experiences about volunteer service. In this case,
     research and travel expenses may be provided within a budget.
(7) Chairman shall decide upon other matters necessary for its composition and operation through consultations of the
     committee.
Article 4 (Composition of Working Group of Volunteer Service Promotion)
(1) Working group of volunteer service promotion ( hereinafter referred to as the "working group") prescribed by Article 8(3)
     is composed of less than 25 working group members including 1 chairman and 2 vice chairman. A working group member
     is person who is falling under any of the following subparagraph.
     1. Ex officio working group member: Director in charge of volunteer service from The Ministry of Finance and Economy,
        Ministry of Education and Human Resources Development, Ministry of Justice, Ministry Health and Welfare, Minister
        Gender Equality and Family, Ministry of Planning and Budget, National Police Agency, National Emergency
        Management Agency, and Government Youth Committee
     2. Private Working Group Member: Among those who have in-depth knowledge and experience about voluntary service,
        person who is recommended by Korea Council Volunteering prescribed by Article 13, the Minister of Education & Human
        Resource Development, Minister of Health and Welfare, Minister of Gender Equality and Family or Chairman of
        Government Youth Commission and appointed by the Prime Minister
(2) Chairman of working group shall be the 2nd vice minister of the Government Adminstration and Home Affairs. Vice
     chairman is person elected by mutual vote private working group members, and the civil servant in charge of volunteer
     service from the Ministry of Government Administration and Home Affairs.
(3) Private members shall be a majority among working group members as prescribed in paragraph 1.
(4) Private working member shall serve 2year term.
(5) Director in charge of volunteer service from central government organization designated by president of working group
     may be present and speak at the working group, if necessary.
(6) 1 manager shall be in the group to deal with office work and he or she shall be a civil servant in charge of volunteer service
     from the Ministry of Government Administration and Home affairs
(7) Chairman shall decide upon other matters necessary for composition and operation of working group through
     consultations of the committee.
Article 5 (Establishment of National Basic Plan Concerning Promotion of Volunteer Service Promotion)
(1) The Minister of Government Administration and Home Affairs shall establish basic plan concerning promotion of volunteer
     service(hereinafter referred to as "basic plan") as prescribed in Article 9 one year earlier before it is to be put into practice.
(2) The Minister of Government Administration and Home Affairs shall consult relevant head of central government
     organization when basic plan is to be established and it shall be deliberated by the committee.
Article 6 (Establishment and Enforcement of Implementation Plan)
(1) As prescribed in the Article 10, mayor, county headman, and ward head(referred to as "head of autonomous region")
     shall submit implementation plan concerning promotion of volunteer service in their jurisdictions to Mayor of Seoul
     metropolitan city, Mayor of metropolitan city, Governor (hereinafter referred to as "mayor and governor) by the end of
     December.
(2) Head of relevant central government organization, mayor, and governor shall submit current year's implementation plans
     in their jurisdictions to the Minister of Government Administration and Home Affairs by the end of January. The Minister
     of Government Administration and Home Affairs shall put the plans together, confirm them after deliberations by the
     committee, and notice head of central government organization, mayor, and governor by the end of March.
(3) Mayor, county headman, and ward head shall submit results of last year's implementation plans to mayor and governor
     by 15, January every year and head of central government organization, mayor, and governor shall submit them to the
     Minister of Government Administration and Home Affairs by the end of every January.
(4) The prime Minister may allow the Minister of Government Administration and Home Affairs to monitor and evaluate the
     results of implementation plans as prescribed in the Article 3 and submit them to the committee. And the minister may
     seek consultations of research institutes or ask them to conduct research and study, if necessary.
Article 7 (Requests for Cooperation from Relevant Organizations)
As prescribed in the Article 5 and 6, the national and local governments may ask cooperations such as submission of necessary documents and opinions concerning establishment and enforcement of basic and annual implementation plans about public, volunteer service, and other private organizations, if necessary.
Article 8 (Rewards)
Process of selecting awardees, and grade of medals as prescribed in the Article 12 shall refer to the law on 「prize and decoration.
Article 9 (Events on Volunteer's Day and Volunteering Week)
The national, local governments, and volunteer organizations may hold any of the following events to commemorate Volunteer Day and Volunteer Week as prescribed in the Article 13.
1. Commemorative events
2. Presentation of the results of research and international exchange events
3. Encouragement on man of spirit and meritorious organizations
4. Public relations through mass communications
5. Other events to raise awareness of the public on promotion of volunteer service
Article10 (Insurance of volunteers, etc)
(1) The national and local governments may allow volunteer organizations and centers to take necessary measures such as
     safety education on volunteer service accompanying danger, etc in advance.
(2) Kinds of protection of volunteers as prescribed in the Article 14(2) refer to the following subparagraph.
     1. Physical protection of volunteers while performing volunteer service
     2. Protection of economic loss of volunteers happened while performing volunteer service
     3. Protection of others' physical and property damage happened while performing volunteer service
(3) The national and local governments may purchase insurance and mutual aid which meet any of the following
     requirements to protect volunteers from volunteer organizations or groups as prescribed in [non-profit organization
     assistant act].
     1. Being able to compensate for volunteer's death, aftereffects and injury, medical expenses, hospitalization fee,
        and surgery cost incurred during volunteer service
     2. Being able to compensate for others' physical damage and property loss incurred during volunteer service
(4) Local governments shall determine purchasing process and ways of insurance as prescribed in the Article 3 through
     ordinance.
Article11 (Education and Training)
Volunteer organizations and centers may commission education and training to relevant educational facilities to help volunteers to perform volunteer service safely, as prescribed in the Article 15.
Article 12 (Use of National and Public Resources)
(1) The national or local governments may allow the following projects of volunteer organizations and centers to lend or use
     national and public resources for free:
     1. Projects concerning international events
     2. Projects concerning disaster relief and recovery
     3. Other projects that volunteer organizations and centers deemed necessary for promotion of volunteer service In this
        case, national and public resources shall not be lent and used for the use of office or lending and use period shall not
        be more than 1 year.
(2) Process and ways, etc concerning lending and use of national and public resources for free refer to the provisions of the
     National Property Act and the Public Property and Commodity Management Act.
Article 13 (Members of Volunteering Korea, etc)
(1) Members of Volunteering Korea (hereinafter refer to as the "council") as prescribed in the Article 17 are those who are
     falling under any of the following subparagraph.
     1. Representatives from non-profit corporations and organizations whose main jobs are volunteer service
     2. Person who goes through consultations from the board of directors of the council deemed necessary for promotion of
        volunteer service
(2) The council shall have officers more than 20 but less than 50 directors including 1 chief executive officer, and 2 inspectors.
(3) A officer shall be elected in general assembly according to bylaw.
(4) A officer shall serve 2 year terms and may be reelected.
(5) Necessary matters concerning officers' qualifications, ways of selection, and operations of the council shall be decided by
     the council's bylaws.
(6) Except provisions concerning the council in this decree, provisions concerning incorporated association of [civil law] shall
     be applied.
Article14 (Requirements of Head of Volunteer Center)
(1) Requirements of head of volunteer center as prescribed in the Article 19 are the followings:
     1. Person who has served as an assistant professor or higher level professor in volunteer service related department for
        more than 3 years
     2. Person who has engaged in volunteer service management in volunteer organizations and centers or social welfare
        organizations or facilities, schools, and businesses for more than 5 years
     3. Retired civil servant of grade 5 who has engaged in volunteer service or social welfare job for more than 3 years
     4. Person who has worked as an officer in volunteer service related civic group registered at the national and local
        governments for more than 10 years
(2) Head of volunteer center shall be selected through open competition
(3) Local governments shall determine ways and procedures of selection of volunteer center head through ordinance.
Article 15 (Organization and Operation of Volunteer Center)
(1) An executive office shall be established in volunteer center to deal with its office work.
(2) Steering committee shall be established for smooth operation of volunteer service center. Provided, that volunteer center
     is managed in the form of incorporation, the Board of Directors shall be established.
(3) Steering committee as prescribed in the Article 2 shall be consisted of not more than 20 members. Representatives of
     volunteer centers shall be more than a majority with a private member being top representative.
(4) Volunteer centers in Seoul Metropolitan City, metropolitan city and provinces shall carry out any of the following projects
     to promote volunteer service in community.
     1. Establishment of permanent cooperative framework with organizations and groups in Seoul metropolitan city,
        metropolitan city, and provinces
     2. Education and training of managers and leaders in volunteer service
     3. Development and distribution of volunteer service programs
     4. Research and study on volunteer service
     5. Operation of Volunteer service information centers
     6. Exchange of Information and cooperation, adjustment, assistance of projects between volunteer centers in cities,
        counties, and autonomous districts
     7. Other projects that may make contributions to promotion of volunteer service in Seoul metropolitan city, metropolitan
        city, provinces
(5) Volunteer centers in city, county, and autonomous districts shall carry out any of the following projects for promotion of
     volunteer service in their communities.
     1. Establishment of permanent cooperative framework with organizations and groups in city, county, and autonomous
        districts
     2. Recruits and education of volunteers and volunteer service promotion
     3. Arrangement of volunteers at organizations and groups which need them
     4. Development and distributions of volunteer programs and pilot operations
     5. Gathering and offering of volunteer service related information
     6. Other projects which can make contributions to promotion of volunteer service in city, county, and autonomous districts
(6) Local governments shall decide on matters concerning organization and operation of volunteer centers through ordinance.
Addenda
(1) (Enforcement Date) This decree shall enter into force on the day of its promulgation.
(2) (Interim Measures Regarding Head of Volunteer Service Center) At the time of the enforcement of this Decree person
     appointed as a head of volunteer service center is deemed to be appointed by provisions of the Article 14.
(3) (Interim Measures Concerning Volunteer Service Ordinance) Volunteer service related ordinance which is in effect at the
      time of the enforcement of this decree is deemed to be ordinance falling under this decree. Provided, it shall be amended
     in accordance with this decree within 6 months of its promulgation.
